Registration modification: Can a Registered Work Be Modified?

Once a work has been registered, certain key elements cannot be modified because the registration proof certifies that this is the work at the UTC date and time of registration. However, some aspects can still be updated.

1. What CANNOT be changed?

The following elements cannot be modified after registration:

  • The title of the work
  • The author
  • The content of the work

This is because the registration acts as proof of a specific version at a specific point in time.

Options if the Work Is Modified

If the work undergoes a substantial change, it must be registered again, creating a new proof with its own registration code, hash, and timestamp.

  • If the new version is corrected or expanded, it should be registered as a derivative work, in accordance with Article 11 of the Intellectual Property Law (LPI).
  • If you have a personal or corporate subscription, you can use the version registration feature, which links different versions together. If the records are public, this link will be visible.
  • Regarding the title of the newly registered work, the LPI does not prohibit keeping the same title as the original version. However, this could lead to conflicts if the title is not original and is already used by another work.

Rectifications for Typographical Errors

If there were typos in the title or author’s name when registering the work, it is possible to request a rectification. However, these corrections should only apply to minor errors and not involve substantial modifications.

2. What CAN be changed?

As long as the registration remains active, the following aspects can be modified:

  • The declared rights reservation (the work’s license).
  • The visibility of the registration (whether the work is public or private).
  • The ability to download the original file (whether others can download the work when checking its rights).

Notes on Work Titles

A work's title is not protected under copyright unless it is original and has a distinctive character, according to Article 10.2 of the LPI.

  • It is common and legal for different authors to use the same title for different works (e.g., two songs both titled The Sunset).
  • However, if the title has originality and distinctiveness, like Alice in Wonderland, it may be protected.
