This document affects the data processing carried out on all platforms and tools developed by Safe Creative and offered through the pages safecreative.org, safestamper.com, and their subdomains.
The use of Safe Creative or Safe Stamper services implies the express acceptance of this Privacy Policy. This document regulates the processing of personal information of all users. In the case of registered users, it contemplates, in addition to the policy regarding personal information, the policy regarding access credentials to the service and the security measures implemented that prevent the access, modification, or deletion of our files by unauthorized persons.

If you use the certification and stamping services of Safe Stamper, you should take the precaution of keeping private or password-protected those certificates whose access you wish to restrict. The URL of our certificates allows their visualization, public or restricted, so that third parties can verify them. In any case, you will be the one who has control of the decision on the level of access, depending on the use you are going to give to the certificate.
Whenever you wish, you can access your personal information, modify the privacy of your information within the limits established by the service, and, if you wish, update or delete your personal data from the My Account control panel. In the latter case, in order to avoid accidental deletions or those made by third parties, your data may be preventively blocked without being immediately deleted.

Safe Creative does not transfer personal data to third parties except by legal obligation or in specific compliance with the provisions of the Legal Conditions. The data may be communicated to other companies and to official partners of Safe Creative for internal administrative purposes and when necessary to facilitate services requested by the user.
Information registered in Safe Creative may be combined with that collected by collaborating companies. In these cases, Safe Creative will notify you of the receipt of the information and will send you a copy of this Privacy Policy so that you can state whether you wish to remain in our systems, although it will not be responsible for previous processing carried out by third parties outside Safe Creative.
The computer subsystems for data storage used by Safe Creative may be subcontracted to companies providing computer services located in Europe or the United States, and therefore subject to the data protection regulations of the corresponding legislations in each case and moment; for example, Amazon Web Services (AWS). The data may be subject to international transfer, in which case the corresponding legal measures will be adopted, such as the use of specific contractual clauses.

In the case of using Safe Creative services that require the provision of personal data from third parties (for example, the registration of rights in the name of third parties), it is the user who registers this information who is responsible for the consequences derived from their action, and if necessary, for rectifying and deleting the data, and states having informed said third parties about the communication of their data to Safe Creative and the processing of the same for the appropriate purposes.
In relation to the licensing services of works through NFT, the identification and verification data requested will be communicated to Stripe Technology Europe, Limited, a limited liability company with registered office at The One Building, 1, Lower Grand Canal Street, Dublin 2, Ireland, all for the purposes of complying with the corresponding legal obligations. This communication of data is necessary to make use of these services. The processing of the data corresponding to the account services in Stripe will be carried out by said entity independently and separate from Safe Creative.
Likewise, within the framework of rights transfer or licensing operations, the identification data of the parties involved will be communicated to the other party. In particular, the data of full name, email address, domicile, and tax data of each of the parties will be communicated to the other party for the purposes of formalizing the corresponding contract and for the fulfillment of the administrative, fiscal, and accounting obligations of the parties.
Safe Creative continues to have the obligation to guarantee compliance with the LOPDGDD and the GDPR regarding storage, access, and possible dissemination of the personal data contained in the published material.
Safe Creative's use of Google Workspace APIs is limited exclusively to what is necessary to perform automated registration of works from Google Drive or Google Photos, if the user has activated this functionality. Safe Creative uses Google Workspace APIs solely for the purposes authorized by users and within the established security and privacy framework, without allocating them to any type of analysis or processing that exceeds the specific purposes of our service.

Safe Creative has adopted the legally required levels of protection for Personal Data, and endeavors to install those other additional technical means and measures at its disposal to prevent the loss, misuse, alteration, unauthorized access, and theft of Personal Data provided to Safe Creative. Despite the security measures implemented, Safe Creative cannot guarantee total immunity against incidents derived from external factors beyond its control.
Safe Creative is not responsible for hypothetical damages or losses that could arise from interference, omissions, interruptions, computer viruses, telephone failures, or disconnections in the operational functioning of this electronic system, motivated by causes beyond Safe Creative; from delays or blockages in the use of this electronic system caused by deficiencies or overloads of telephone lines or overloads in the Data Processing Center, in the Internet system or in other electronic systems, as well as actions by third parties, including cyber attacks, unauthorized access or the improper use of technologies such as artificial intelligence outside the control of Safe Creative.
Safe Creative recognizes that the evolution of artificial intelligence poses new challenges in terms of data security. Although mechanisms have been implemented to prevent illegitimate access or manipulations through Artificial Intelligence, Safe Creative assumes no responsibility for damages arising from activities carried out by malicious actors who use advanced technology to breach security systems, provided that such actions are beyond the reasonable control of Safe Creative.
Safe Creative is committed to keeping users informed about any improvement in the adopted security measures, as well as to timely notify any security incident that may affect their Personal Data, in accordance with the provisions of the GDPR and applicable regulations.
In general, Safe Creative will retain your data for the time necessary to carry out the procedures that correspond according to the indicated purposes, and subsequently and duly blocked until the prescription of the possible legal responsibilities that derive from the above.
With respect to registered users, your data will be kept as long as the contractual relationship lasts and you do not cancel your registration, and subsequently, until the prescription of the possible legal responsibilities that could arise.
For the purposes of sending commercial communications, we will keep your data indefinitely, although you may revoke the consent given at any time, as well as exercise your right of deletion or oppose said processing.
All of this without prejudice to the conservation of navigation data, captured through the use of cookies and other similar technologies, whose processing and conservation is carried out in accordance with the provisions of our Cookie Policy.
At any time, you may exercise the rights of access, rectification, opposition, deletion, limitation of processing, and portability of your data, as well as not being subject to a decision based solely on the automated processing of your data, under the legally established conditions and by writing to the email address pd@safecreative.org
We will respond to your requests within a maximum period of one month from the receipt of your request. This period may be extended if necessary, taking into account the complexity and the number of requests, in which case we will inform the interested party of the extension within the first month from the request. Likewise, we inform you that you have the right to file a complaint with the Spanish Data Protection Agency in case you consider that the processing of your data is not adequate.
In principle, our services are not specifically directed at minors, however, in the event that any of them is directed at minors under fourteen years of age, in accordance with the GDPR and the LOPDGDD, Safe Creative will require the valid, free, unequivocal, specific, and informed consent of their legal guardians to process the personal data of minors. In this case, the ID card or other form of identification of the person giving consent will be required.
In the case of those over fourteen years of age, the processing of data may be carried out with the consent of the user, except in those cases in which the Law requires the assistance of the holders of parental authority or guardianship.
We reserve the right to modify this privacy policy at any time, publishing the updated version on the website and notifying users when legally necessary.
This privacy policy is governed by Spanish and Community legislation that is applicable to it.
For the resolution of any controversy, the parties submit to the Courts and Tribunals of Zaragoza.
