Privacy policy

This document affects the data processing performed on all the platforms and tools developed by Safe Creative S.L. and offered on the safecreative.org and safestamper.com websites and their subdomains.

Using the services of Safe Creative or Safe Stamper involves express acceptance of this Privacy Policy. This document governs the processing of all users' personal information. In addition to the policy on personal data, it also envisages, in the case of registered users, the policy on access passwords to the service and the security measures implemented to prevent access to, alteration or deletion of our files by unauthorised persons.

Said processing shall be governed by the provisions set forth in EU General Data Protection Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (GDPR) and Spanish Organic Act 3/2018 of 5 December on the Protection of Personal Data and Safeguarding Digital Rights.

Data collected

The data collected by Safe Creative includes:

  • Personal information provided by you in the signing up and registration process, such as your username, name, surname, e-mail address, telephone numbers, access password, physical address, type and identity document. Any fields marked with an asterisk (*) are mandatory and the data requested by them must be entered, otherwise the relevant request shall not be processed.
  • If you register by identifying yourself using your Google account information, we shall gain access to your Google username, e-mail address, name identifier and image. You shall be informed of the above prior to using Google to gain access, though in any case we recommend that you visit Google's terms and conditions of use prior to doing so in order to obtain detailed information on the relevant implications thereof.
    If you additionally wish to synchronise your Google Drive account to automate registrations at Safe Creative, we shall gain access to the Drive folder you specify for such purpose and a new folder will be created with this function.
  • Information on the transactions and payments you make through the services.
  • Data generated through your access to and use of the services we offer, including queries or suggestions, activities in our server logs, your browser settings, the IP address you use to gain access and the web pages requested.
    • As regards intellectual property services, we shall process the data associated to registered works, such as their title, type, licences, rights, the file containing the work and interactions, such as access to it and download or reproduction of it.
    • As far as Safe Stamper is concerned, information associated to certified services. Said information includes date and time, type, Internet address (URL), image, video file and any other data generated, the content of any communications sent, including the sender and recipient's e-mail address, the user's electronic signature files and certificates, depending on the type of service.
    • In the case of online gallery services and licensing of works on NFTs, the data and information related to said works, accesses and licences or rights granted to third parties, specific information and verification in accordance with Clause 3.3 of the Legal Terms and Conditions, the data associated to the NFTs generated, and information on buyers and transferees.
  • Cookies and similar technologies to improve the way our platforms operate, keep the session open and tailor the user experience, as well as to collect anonymous web usage statistics. More detailed information can be consulted in our Cookie policy.

How We Use the Data

Safe Creative only collects the data that are necessary to be able to offer the services requested. For such purpose, your data shall be used so we can:

  • Process Safe Creative services in accordance with the Legal Terms and Conditions; fulfil our administrative, tax and accounting obligations; and manage queries and customer services, all of which are necessary to ensure the provision of our services.
  • Analyse visits, traffic and browsing on our websites according to the Cookie Policy, all in keeping with your consent.
  • Via the use of mobile device applications, data shall additionally be collected on your Google Play or Apple Store identifier, device, operating system and version, uses and functionalities used. Furthermore, access may also be gained to contact data, saved files or data connectivity. The relevant information and access permits shall be indicated at the time such applications are downloaded and installed.
  • Contact you in case of incidents.
  • Provide anonymous reports both internally and for external clients.
  • Send you by e-mail notifications, bulletins or newsletters on our activities, products or services on the grounds of our legitimate marketing interest or where you explicitly request them.

Data Publicly Shared by You

If you use Safe Creative intellectual property registration services, the only information which we shall publicly disclose about you on the www.safecreative.org website shall be the information on the public registrations you make, including:

  • Name or pseudonym provided when registering the work.
  • Title of the work.
  • Identification code of the work.
  • Type of work.
  • Synopsis.
  • Date and time of registration.
  • Rights policy concerning the work.

If you additionally choose to use our "Creators" promotional platform, links to your social media and the full or partial content of the work may be added to said data.

The work's content and other data shall only be accessible to third parties should you so decide.

If you use the Safe Stamper certification and stamping services, you should take the precaution of ensuring that any certificates to which you wish to restrict access are kept private or password protected. Our certificates' URL allows them to be displayed publicly or in a restricted way in order to allow third parties to verify them. In any event, you shall have control over the decision on the level of access depending on the use you intend to make of the certificate.

You may access your personal information, change your information's privacy within the limits set for the service and, if you so desire, update or delete your personal data on the My account control panel whenever you wish. In the latter case, your data may be blocked as a precautionary measure without being immediately deleted in order to prevent accidental deletions or deletions made by third parties.

External Processing

Safe Creative S.L. does not transfer personal data to third parties unless it is legally obliged to do so or in order to fulfil the provisions of the Legal Terms and Conditions. The data may be communicated to Safe Creative's other companies or official partners and where it is necessary to provide services requested by the user.

Information registered at Safe Creative may be combined with any information collected by collaborating companies. In such cases, Safe Creative shall notify you of the information's reception and shall send you a copy of this Privacy Policy so you may state whether you wish to remain in our systems, though it will not be responsible for the aforementioned processing carried out by third parties that are external to Safe Creative.

The data storage IT subsystems used by Safe Creative may be outsourced to IT service providers located in Europe or the United States and therefore subject to the data protection regulations of the relevant legislation from time to time like, for instance, Amazon Web Services (AWS). The data may be transferred internationally, in which case appropriate legal measures shall be taken, such as the use of specific contractual clauses.

In the case of using Safe Creative S.L. services that require providing personal data not belonging to the user (for instance, registering rights on behalf of third parties), the user who registers said information is liable for the consequences arising from their action and, if necessary, of rectifying and deleting said data. Such user must also state that they have informed the aforementioned third parties about the communication of their data to Safe Creative and of the processing thereof for the relevant purposes.

As regards licensing services of works on NFT, the identification and verification data requested shall be communicated to Stripe Technology Europe, Limited, a limited liability company whose registered office is at The One Building, 1 Lower Grand Canal Street, Dublin 2, Ireland, for the purpose of fulfilling any legal obligations which apply. Said communication of data is necessary to make use of these services. The processing of the account services' data at Stripe shall be carried out by said entity independently of Safe Creative and separately from it.

Furthermore, within the framework of transfer or licensing transactions, the identification data of the parties involved shall be communicated to the other party. In particular, the full name, e-mail address, address and tax data of each of the parties shall be communicated to the other party for the purposes of entering into the relevant agreement and fulfilling the parties' administrative, tax and accounting obligations.

Limitations on the Use of Google Workspace APIs for AI and ML

Safe Creative’s use of Google Workspace APIs is strictly limited to what is necessary to perform the automated registration of works from Google Drive or Google Photos, if the user has enabled this functionality. This data is not used to develop, improve, or train generalized artificial intelligence (AI) or machine learning (ML) models. Safe Creative uses Google Workspace APIs solely for the purposes authorized by users and within established security and privacy frameworks, without engaging in any analysis or processing beyond the specific purposes of our service.

Sensitive data protection

All Safe Creative services include information security features.

If we detect a risk that we think you should be aware of, we will contact you and advise you of the steps you should take to enhance your protection.

We make every effort to protect Safe Creative and our users from any unauthorized alteration, disclosure or destruction of the data we maintain or unauthorized access to this information.

We do this by:

  • We have different security features, such as Safe Browsing or security review to help you protect your account.
  • We review our data collection, storage and processing practices (including physical security measures) to prevent unauthorized access to our systems.
  • We restrict access to personal information so that only those Safe Creative employees, contractors and agents who need the information to process it can access it. All who have access to this information are subject to strict contractual confidentiality obligations and may be disciplined or terminated if they fail to comply.

Data Retention and Exercising Your Rights

In general terms, Safe Creative shall keep your data for the time needed to perform the relevant procedures according to the aforementioned purposes and shall duly block them subsequently until the statute of limitations of any possible legal liabilities arising from the above has expired.

As far as registered users are concerned, their data shall be kept while the contractual relationship lasts and they do not cancel their registration until the statute of limitations of any possible legal liabilities that may arise has expired.

We shall keep your data indefinitely for the purpose of sending marketing communications, though you may withdraw the consent you have granted from time to time, as well as exercise your right to the elimination of said data or to object to the aforementioned processing.

All the foregoing shall be without detriment to keeping any browsing data collected through the use of cookies and other similar technologies, the processing and retention of which is done in accordance with the provisions set forth in our Cookie Policy.

You may exercise the rights of access and to rectification, objection to processing, erasure, restriction of processing of your data, along with the right to not be subject to a decision solely based on your data's automated processing under the legal terms envisaged by writing to the e-mail address pd@safecreative.org. We likewise inform you that you are entitled to lodge a complaint at the Spanish Data Protection Agency (Agencia Española de Protección de Datos) should you consider that your data have been improperly processed.
