Registering Your Brand for Your Professional Activity:

Step 1: Brand and Countries

• Choose to register your brand for your professional activity.
• Specify whether you are registering your name, pseudonym, or artistic name, a logo, or an image with a name and logo. [More info]

Step 2: Brand Details

• Enter your brand name or upload the logo image file, depending on your choice.

Step 3: Distinctive

• Select your professional activity from the dropdown and click "Next."
• Complete the applicant details, which will be pre-filled if you are already a user.
• Confirm the information, accept the terms of use, and click "Pay."
• Enter payment details and confirm by clicking "Continue."
• Lastly, sign the authorization digitally for us to proceed.

Important: If the preliminary registration analysis finds that your brand cannot be registered due to existing similar names or invalid designation, the fee will be refunded and the request canceled.

Registering Your Brand for Identifying Services or Products:

Step 1: Brand and Countries

• Choose to register your brand for identifying products or services.
• Specify if you will use the brand name, logo, or an image including the logo and name.
• Select the countries and click "Continue."

Step 2: Brand Details

• Enter the brand name or upload the logo image file as chosen previously.

Step 3: Distinctive

• Select your professional activity from the dropdown or click on "Add Use" to specify the use or uses, determining the Nice class for registration. Don’t forget to click "Save." This option already includes a basic analysis of registrability.

You can also request a full analysis with coverage advice, including a detailed review of the Nice classes and the most suitable description of specific products or services for your needs.

• Click "Next," fill in the applicant details (which are pre-filled if you are already a user), confirm, accept the terms of use, click "Pay," and then sign the digital authorization to proceed.

When registering a trademark, it is important to choose the correct type that best represents the intended use. The three types of trademarks available—Word, Figurative or Graphic, and Composite—offer different forms of protection. Below are the different types, along with criteria for choosing each:

Word Mark: This type of trademark consists solely of words, letters, numbers, or any combination of these elements without a specific design. It is appropriate for protecting the name of a product or service. Choosing a word mark is suitable when you want to protect the name itself, regardless of its visual presentation.

Figurative or Graphic Mark: This includes graphic elements, symbols, logos, and other visual forms that do not include text. This type of mark is suitable for protecting an icon or a specific design that identifies the products or services without being accompanied by text. It is particularly useful for creating a distinctive visual identification in the mind of the user.

Composite Mark: This combines word and figurative elements. It includes both text and graphic design. This type of mark registers the brand name with its logo in a combined manner, providing broad protection for both the verbal and graphic elements. Choosing a composite mark is recommended when both aspects (text and design) are presented together, and you want protection for the combined representation.

If both the text and the image are distinctive elements you wish to protect, you can either file a single application for a composite mark or file two separate applications: one for a word mark to register the text and another for a figurative or graphic mark to register the image. The latter option is often advisable because it offers the following advantages:

• Greater protection: If you have filed for a composite mark and someone later files for another composite mark with similar text but a different design, it could be accepted as it may be considered distinct from yours as a whole.

• Maintaining protection if your logo changes: Logos often evolve over time. If you have filed for a word mark instead of a composite mark, changing your logo will not affect the protection of your trademark. In some jurisdictions, not using the mark as registered can even be grounds for cancellation.

• Greater flexibility of use: Separately protecting the name of the mark and the logo provides more flexibility in using the trademark in different ways.

The validity period of a trademark registration in almost all countries is 10 years from the registration date. This term is renewable indefinitely every 10 years, provided that the renewal requirements set by the respective trademark office are met, including the payment of renewal fees.

It is important to keep the trademark active in the market and comply with the renewal formalities to prevent the registration from expiring. If the trademark is not renewed on time, the legal protection it offers may be lost, and the trademark could become available for registration by other individuals or companies.

When applying for trademark registration, you must consider the common restrictions imposed by trademark offices in most countries.

• The following cannot be registered as trademarks:
  
  Generic and descriptive names: Terms that generically describe a product or service or its characteristics cannot be registered. For example, the word "book" cannot be registered for a company that sells books.

• Common symbols and terms: Symbols, terms, or signs that are of common and public use cannot be exclusively appropriated by an entity. This includes common traffic signs, informational terms like "new," or symbols indicating something (such as an exclamation mark).

• Heraldic figures and symbols of public entities: Coats of arms, flags, and other official emblems of states, international organizations, and other public entities are not registrable without the appropriate authorization.

• Well-known geographic names: Names of well-known places that are associated with a particular type of goods or services cannot be monopolized by a trademark, as they may mislead regarding the geographical origin of the products or services.

• Deceptive signs: Any trademark that may confuse the public about the nature, quality, or geographical origin of a product or service is inadmissible for registration.

• Expressions and symbols contrary to morality or public order: Trademarks containing or constituting expressions contrary to public morality, offensive, or inappropriate symbols are prohibited in many countries.

• Identical or similar marks: Trademarks that are identical or very similar to others already registered or in the process of registration cannot be registered to avoid consumer confusion and to protect the rights of existing trademark holders.
