The registration of authorship in Safe Creative provides the author with irrefutable technological proof of his declaration and the consequent protection of his rights (Berne Convention - UN). It is therefore highly advisable to register a work before "moving" it, in order to have a first declaratory proof of its authorship, to publish the work or send previous versions with peace of mind, knowing that the best proof is available in time against those who might be tempted to attribute it.

The main differences between the registration of authorship in a traditional registry and Safe Creative are:

Safe Creative also offers complementary services such as optional public information of the work, registration of related rights (production, distribution, illustration, etc.), registration of "copyleft" licenses, labeling, metadata, link to informative pages of the author, etc.

Any kind of work, document of file can be registered at Safe Creative, however you must be aware that not all works are protected by copyright laws. According to the World International Property Organization’s Berne Convention for the Protection of Literary and Artistic Works copyright include:

Literary works: articles, tales, novels, essays, posts, electronic pages, etc.

Dramatic and audiovisual works: movies, animations, theater, short films, etc.

Musical works: musical compositions, phonographic productions, scores, etc.

Artistic works: drawings, paintings, designs, three-dimensional models, sculpture, engravings,
lithographies, comics, photography, etc.

Databases and software (in some legislations): the code (whatever format) and their manuals and related technical documents, graphics and description modules.

Can we register brands, inventions, trade names, ideas, projects, methods, etc.?

Trademarks are not artistic, literary or scientific creations (works protected by copyright), but words, symbols, devices or names used for commercial purposes.

To obtain a trademark or a trade name, an administrative procedure must be followed through an official body and the corresponding fee must be paid, similar to what must be done to register a patent, and it is granted for a limited period of time. Safe Creative is not a site to register social, economic, festivals, learning methods, concepts, events, etc. projects. Those would be considered ideas by themselves and are excluded to generate copyrights by local copyright laws and international agreements.

What is Creators and how does it work?

Creators is the dedicated space for artists on Safe Creative, where you can get known, promote your portfolio, connect with your followers, showcase your art, sell your digital works, or offer professional services.

Plus, you have the chance to win prizes!

You decide which registered works you want to exhibit. For those you put up for sale, you can set a price and define the usage rights the buyer will acquire. Alternatively, you can allow the buyer to propose a budget, specifying the rights to the work they wish to acquire.

How to activate my Creators profile?

If you have an active subscription on Safe Creative, you can open your space on Creators by following these steps:

1. Go to the upper right corner, click on LOGIN, and sign in with your Safe Creative username and password.
2. Once logged into your profile, click on your name in the upper right corner and go to “Edit Profile”.
3. In this section, you can complete your profile by adding a cover photo, a profile picture, a description,  acknowledgments, tags, and relevant links.
4. Don’t forget to click “Save” when you’re done.

How to add works to my profile?

You can add a new work from any of the tabs by looking for the “+” symbol, which will appear on the right side of your screen (once you’ve logged in). Click on it, and your works from Safe Creative that you haven’t yet published on Creators will appear.

Select the work or works you want to publish and click continue. In the next tab, you will need to add a description of the works and complete the corresponding data. When finished, don’t forget to click “Save changes”.

How to sell my works on Creators?

You can sell each work in the way you prefer: exclusively to a single buyer, thus transferring all rights; non-exclusively, allowing the buyer to acquire a copy for personal use and enjoyment; or by allowing the buyer to request a quote specifying the characteristics of the license they need.

How to buy works or licenses on Creators?

Anyone or any company can purchase licenses to use works on Creators. To make the payment and acquire the “certificate with the acquired license”, you must register on Safe Creative (for free).

You can directly find the works in their category (Visual, Music, or Literature) that display a fixed price, or those that have an “Open Price”. In the latter case, you can select the use you want to give the work and request a quote.

Once the payment is made in local currency, with a credit card (VISA / Mastercard...), Creators will provide you with the download of the work and the digital certificate of the license. If you choose to acquire the license as an NFT, you must indicate the Metamask digital wallet code where you wish to receive it.  See more

Intellectual property registration does not grant rights, as the author of a creative work automatically holds both moral and economic rights without the need for registration (Berne Convention).

However, it is highly recommended to register the work before sharing, publishing, or sending it, as this allows:

• Establishing an initial proof of authorship.
• Having the best time-stamped evidence against potential infringers who may attempt to claim and unlawfully benefit from the work.

Safe Creative provides two permanent evidentiary elements that the author can keep and use to defend their rights, regardless of whether they remain a Safe Creative user:

1. Proof of authorship

• Includes the original work file and its three cryptographic hashes.
• Features a double timestamp that certifies the date and time of registration.
• Audited in blockchain, ensuring data integrity.

2. Certificates of authorship and rights

• Safe Creative issues official documents detailing the registration information.
• The electronic certificates guarantee their authenticity and permanent validity.

If the author chooses to make the registration public, Safe Creative will display the details on a publicly accessible webpage.

The best technology for all registrations and users

Safe Creative applies the same advanced technology to all registrations, regardless of the user’s account type:

• Triple digital fingerprint for work identification.
• Redundant timestamping with an accredited external service.
• Ethereum-based audit for enhanced security and transparency.

Both registrations: Provide valid proof of presumed authorship, which allows for contrary evidence.

Neither registration: Is mandatory or grants authorship rights, as the author acquires those rights simply by creating the work.

The evidence provided by both is based on the date on which the work was already in the author's possession and the responsible authorship declaration was registered; therefore, the greatest protection is achieved by registering the work before disclosing it, in order to have the strongest time-stamped proof.

The difference between the two lies in the nature of the proof they provide to the author.

• The official registration of a country provides a signed document as proof. As it has official status in its country, it is admitted as evidence, and the veracity of its content is presumed.
• Safe Creative provides as proof a file with a double timestamp to guarantee the date of registration, which contains the work together with three cryptographic fingerprints of the work to confirm that it is the registered work and that it has not been altered since registration. Additionally, this information is recorded daily in an audit trail on the Ethereum blockchain.
• The certificate of an official registry has evidentiary character in its own country because it is an official document. To use it in processes in other countries, it is necessary to apostille the certificate and ensure that the country where it is going to be used admits the Hague Apostille.
• The Safe Creative certificate, due to its technical nature, has international validity as it is independent of the administrative scope of the country where it has been generated.

Important: Not all countries offer an intellectual property registration service. These differences refer specifically to authorship registrations, not to other types of administrative filings that may be offered by some local registries.

Safe Creative provides essential tools for protecting the intellectual property of creative works. These tools include registration certificates and technical evidence, designed to irrefutably establish authorship and rights over a work. Below is a summary of the key aspects of these elements and how to obtain them.

Safe Creative offers three types of certificates to support the authorship and rights of registered works:

• Work Registration Certificate: A technical document that proves the identity and integrity of the work through a triple identification system (SHA1, SHA256, and SHA512) and double timestamping to ensure the date and time of registration.
• Registration Certificate: Provides a summary of the information registered at Safe Creative, including the registration code, title, author, registration date, and reserved rights.
• Creative Process Certificate: Gathers all the development materials of the work, such as sketches and drafts, dated and stamped, demonstrating the creative evolution of the work.

Safe Creative also provides technical evidence to confirm the date of possession of the work and the rights declarations, including:

• The original work or its description and three digital fingerprints (SHA1, SHA256, SHA512) for identification.
• Double timestamping of the registration to verify the date and time of registration.
• Documentation signed and sealed by Safe Creative that reflects the rights statements made by the user.

These pieces of evidence are crucial for judicial or arbitration proceedings, providing irrefutable proof of the work and its associated rights.

How to Obtain Certificates and Evidence

To download certificates and registration evidence at Safe Creative:

1. Go to the "Works" section.

2. Select the work by clicking on its title or image.

3. In the "Actions / Certificates" section, choose the certificates or technical evidence you need.

For multiple works, you can select them and use the "Manage selected" option to download several certificates or technical documents at once.

Once the registration of a work is completed:

• Go to WORKS

• Click on the image or title of the registered work

• Select the "Registration" tab

• In the left menu, click on “Submitted files”

• Click the "Add creative components" button to attach all the files and/or folders that will serve as evidentiary support for the originally registered work

A certificate of the creative process for that work will be generated and can be downloaded from the "Actions / Certificates" section.

This feature is included with subscriptions.

How Blockchain Audit Registration Works

The incorporation of Blockchain technology into Safe Creative adds an unquestionable audit process due to the public and immutable nature of the blockchain. It has been implemented in such a way that this same strength does not compromise the privacy rights of Safe Creative users.

The audit system generates an electronic document in XML format every 24 hours, containing the relationship of cryptographic hashes of all the registry proofs generated in Safe Creative. The hash of the XML is then incorporated into the blockchain.

Instead of containing the works or the information of the registrations and their rights holders, it contains the digital fingerprints of the same. In this way, if the digital fingerprint of the registered file matches the one included in the audit file, it guarantees that it is the same.

This process allows for the detection of any modification in a registration proof or in the audit XML itself.

This information shows:

1. The cryptographic hashes of the registered works and inscriptions.
2. A link to the audit XML file along with its hash.
3. A link to consult the transaction in the blockchain.
